Nu există reglementări legale uniforme privind arhivarea digitală. Având în vedere că dreptul fiscal și comercial permite stocarea documentelor relevante într-o arhivă digitală, dreptul civil nu recunoaște (pe deplin) o arhivă digitală de aceeași calitate ca și un certificat.

O arhivă digitală adecvată trebuie să includă un jurnal, un sistem protejat prin parolă, o bază de date protejată și utilizarea unui mediu de stocare inalterabil. Documentul arhivat digital obține astfel același statut juridic. Cu alte cuvinte, documentul contează ca dovadă de încredere.

Cu toate acestea, numai semnătura electronică calificată ridică documentul electronic la starea unui certificat. De asemenea, îl protejează împotriva falsificării și verifică în mod neechivoc autenticitatea sa. Prin urmare, este mai de încredere decât o semnătură convențională.
